Terms & Conditions – JKN Logistics B.V.

1. Definitions

Carrier: JKN Logistics B.V., Capelle aan den IJssel, The Netherlands.
Client: The customer, including shipper, consignee and/or billing party.


2. Shipper Load & Count

All shipments must be loaded by the consignor and unloaded by the consignee.
Carrier drivers sign the cargo hand-over receipt as “shipper load and count”.
The absence of this notation does not imply Carrier liability for shortages or damage if the driver was not present during loading or unloading or was not allowed to observe these activities.

The shipper warrants that all cargo is packed adequately to ensure safe transport under normal handling conditions.


3. Rates & Charges

Rates and charges are based on the Carrier’s current standard rate sheet, or a special rate sheet agreed upon with the Client. Rate sheets are available on request for customers in good standing.

Charges may be calculated based on actual or dimensional weight. If applicable, dimensional weight is determined as:
Length × Width × Height / 250 (cm).

All rates are subject to truck availability and applicable fuel surcharges.

Convoy or customs inspector escorts are not included in standard rates. Escort fees depend on HS code, cargo value and required supervision.


4. Application of Terms

These Terms & Conditions apply to all shipments handled by the Carrier, including multimodal transport, unless explicitly waived in a signed written agreement.

Carrier liability shall never exceed the maximum established in through bills of lading, CMR rules, transport documents or agreements with the shipper or beneficial owner.


5. Attempted Pick-Up

If a vehicle is dispatched at the request of the shipper but not used for reasons not caused by JKN Logistics, an attempted pick-up charge and fuel surcharge apply.


6. Free Time & Detention

Free time for loading and unloading is defined in JKN Logistics’ rate sheets.
Detention charges apply if the vehicle is held beyond free time through no fault of the Carrier.


7. Carrier Liability

The Carrier is not liable for loss, damage or delay caused by:

  • Acts or defaults of the shipper, owner or consignee

  • Acts of God, public authority, strikes, riots, embargoes, perils of navigation or war

  • Freezing, spoilage, natural shrinkage or deterioration of perishable goods

  • Special, incidental, indirect or consequential damages, including lost profits

Estimated delivery dates are not guaranteed. Carrier is responsible only for transport with reasonable dispatch under common law definitions.

JKN Logistics is never liable for special, incidental or consequential damages, regardless of prior knowledge.


8. Hazardous Materials

The shipper, consignee or billing party must comply with all regulations concerning hazardous materials. This includes:

  • Providing a legible Dangerous Goods Declaration

  • Supplying complete MSDS documentation

  • Proper packaging, labelling and placarding

  • Including all required emergency contact information

Failure to comply relieves the Carrier of all liability. Misdeclared hazardous cargo may be stored at shipper’s risk and expense, or destroyed without compensation.
Hazardous shipments are subject to additional charges and must be quoted separately.


9. Substituted Service

For operational convenience, the Carrier may hire qualified subcontractors for all or part of the transport.
JKN Logistics will maintain the agreed rates and ensure all terms, obligations and protections remain in effect.

The Carrier may select alternate routing or modes of transport where necessary.


10. Overweight Shipments

Carrier will not knowingly violate weight regulations.
Shippers must provide written notice of overweight cargo in advance.
Any fines, adjustments, permits or compliance costs resulting from overweight cargo will be charged to the shipper.


11. Special Permits

When oversize or overweight permits are required, the shipper must supply them or request the Carrier to obtain them.
Carrier-obtained permits include the permit cost, processing fees and a 15% handling fee.

All cargo is subject to re-weighing and re-measurement by the Carrier or subcontractors.


12. Attempted Delivery

If a shipment is rejected by the consignee through no fault of the Carrier, the shipper is responsible for:

  • All freight charges as if delivered

  • Costs for returning the shipment to origin or another designated point

  • Charges for any re-delivery attempts, each treated as a new shipment


13. Payment Terms

Payment is due within 30 days of invoice date.

The shipper, consignee and owner are jointly and severally liable for all charges, including transportation, advances, disbursements, legal expenses and attorney fees required to collect overdue amounts.

JKN Logistics is not liable for delays or damages caused by:

  • Acts of God

  • Acts of terrorism

  • Public authorities

  • Customs or quarantine officials

  • Weather, strikes, labour disputes

  • Mechanical failures

  • Civil commotion
